Terms of Service

These Terms govern AI Coffee Fail at aicoffeefail.org, operated by AI Coffee Fail Team in the United States (“we” or “us”). “You” means the person using the service or the organization they are authorized to represent. We are an independent project. Our Privacy Policy explains how we handle personal information.

1. Accepting these Terms

Read these Terms before creating an account, submitting a generation or purchasing credits. By proceeding after being presented with these Terms, you agree to them. If you do not agree, do not use those features. Accepting these Terms does not itself provide optional consent to public display, marketing or processing that separately requires consent.

2. Eligibility and accounts

You must be at least 13 to create an account or use the generator. If you are 13–17, you need a parent or legal guardian's permission to use the service; ask them to review these Terms with you. Every depicted person must be a consenting adult aged 18 or older. Anyone under 13 must not create an account or submit personal information. Meet any higher minimum age required where you live. A PayPal purchase must be made and authorized by an adult eligible to use PayPal; do not use another person's PayPal account or payment method without permission.

Generation and purchase history require an account. Provide accurate account information, protect your sign-in credentials, and do not share or resell account access. Buying credits does not automatically start a generation.

3. Generation and delivery

AI Coffee Fail creates a roughly 15-second vertical coffee-mishap video from two authorized photos. Choose Person or Pets mode, an environment, and 480p or 720p quality. The submitted references must both be people or both be pets.

Accepted photos are JPG, PNG or WebP files up to 10 MB each. Availability, queue time and delivery time vary. A task can enter manual review when provider submission or delivery has an uncertain outcome; we do not create a duplicate paid submission while acceptance is uncertain.

AI may change likeness, anatomy, hands or paws, clothing, props, liquid motion, timing, expressions, audio alignment and background details. We validate the file format and basic delivery requirements, but do not guarantee exact identity or motion.

Request a quality review within 48 hours if a required subject is missing or clearly replaced, the core coffee-mishap sequence is absent, or the delivered file is materially corrupted. Confirmed cases receive the 10 or 20 credits consumed by that task; this is separate from a cash refund.

There is no user cancellation control after a generation is submitted. Closing the browser does not cancel it. Do not resubmit while a task is pending or under manual review; contact support with the task identifier if it remains unresolved.

4. Photo permissions

Person mode accepts only photos of consenting adults aged 18 or older, including yourself if you are 18 or older. Pets mode accepts pets you own or are authorized to depict. Do not upload minors, celebrities, public figures, protected characters, or anyone whose permission you do not have, even if an image is publicly available.

Permission to generate does not automatically include permission to publish or commercially use another person’s likeness. Keep any authorization records required by law. We may reject an upload despite claimed permission. Do not bypass a rejection by misrepresenting the subject.

5. Credits and payment

• One-time purchases: the available packs are $6.99 for 20 credits, $12.99 for 40, $17.99 for 60, and $26.99 for 100. Checkout is through PayPal in USD. Packs are not subscriptions and do not automatically renew.
• Costs: Standard 480p uses 10 credits and HD 720p uses 20 credits. Mixed-quality use is allowed.
• Reservation and settlement: we reserve the required credits when you submit. We settle them exactly once only after a completed output is stored. Failed, blocked or invalid tasks release the hold. An ambiguous provider submission remains reserved for manual review and is not automatically resubmitted.
• Expiry: purchased credits expire 365 days after the completed PayPal payment. A refund, reversal or chargeback can revoke the corresponding credits earlier.
• Account use: credits are limited to this service, are non-transferable, and have no cash value except where our Refund Policy or applicable law requires a cash remedy.
• Payment adjustments: a refund, reversal or chargeback revokes the proportional credits associated with that payment. We do not deduct more than the affected package can support, and ledger adjustments are recorded.

Review the package, total, currency, any disclosed taxes, PayPal terms and the 365-day credit expiry before completing payment. Buying credits does not start a generation automatically.

6. Cash refunds

Our Refund Policy forms part of these Terms and explains eligibility, requests, payment processing and shutdown refunds. The main rules are set out below.

You may request a full refund of a one-time credit pack within seven days after completed payment if none of that pack’s credits have been consumed. Failed-task releases and quality-review credit returns are service-credit adjustments, not cash refunds.

To request a refund:

1. Email support@aicoffeefail.org. Preferably send the email from your account address. Include your order identifier if available and state your request.
2. If you cannot access your account or find an identifier, contact us within the seven-day period with the purchase details you have. We may ask for more information to verify the purchase and your authority. Do not include passwords or full payment credentials.

Refunds are reviewed manually; there is no self-service refund button.

If credits are reserved by a pending task, we must establish its outcome before confirming eligibility. A request does not freeze credits; a later successful generation using that pack can affect eligibility. Avoid new submissions while your request is under review.

Approved refunds go through PayPal to the original payment method, and the corresponding credits are removed. We will notify you of the outcome; payment-provider and bank processing times vary. Ordinary change-of-mind requests after seven days, or after credits from that pack were consumed, are not eligible under this voluntary policy. Duplicate charges, unauthorized-payment claims, service defects and refunds required by applicable law are assessed separately.

Nothing here limits mandatory consumer cancellation, withdrawal or service-quality rights. We do not treat accepting these Terms or submitting a generation as a blanket waiver of such rights. Where an express request to begin performance and a separate acknowledgment are legally required, those requirements must be met before relying on any exception to withdrawal rights.

7. Content rights and limited processing permission

You retain the rights you lawfully hold in uploaded content. We do not claim ownership of lawful inputs or saved setup choices. These Terms do not grant third-party permissions or guarantee clearance for a particular use. A downloaded MP4 containing preset audio does not transfer ownership, copyright, synchronization, public-performance, commercial-use, or platform-use rights in that audio. You are responsible for checking the destination platform’s current music, copyright, and synthetic-media disclosure rules before publishing.

You grant us a non-exclusive, royalty-free permission to host, copy, process, transmit, and store your inputs and outputs only as needed to provide generation, delivery, support, security and legal compliance. This includes API Mart as the primary generation provider, Kie API as the fallback, their underlying model operators when used, and the infrastructure providers described in the Privacy Policy. The permission lasts only as needed for those purposes and the applicable retention period; it is not an unrestricted right to reuse your content.

AI Coffee Fail Team does not use your photos or generated media to train or fine-tune AI models. For live generation, API Mart as the primary provider or Kie as the fallback receives temporary signed photo links and generation instructions. API Mart states that it does not use customer data to train AI models and temporarily stores generated outputs only to provide its service. We have not independently verified equivalent behavior across either provider and every underlying model operator. Public use in examples, social posts or marketing requires separate optional authorization for the identified content and use. You may withdraw that permission by contacting us.

Our software, interface, branding, and documentation remain ours or their respective owners’. These Terms give you permission to use the service, not to copy or resell its software or account access.

8. Prohibited use

• Unauthorized use of a person’s image, privacy or other rights; deceptive impersonation, false endorsements, fraud or targeted harassment.
• Nudity, sexual content, non-consensual intimate imagery, pornography, hate, threats or content promoting violence or illegal activity.
• Uploading any person under 18, a celebrity, a public figure, a protected character, or anyone who has not authorized the requested use.
• Payment fraud, unauthorized payment methods, duplicate-account abuse of promotional credits or manipulation of credit and refund records.
• Bypassing moderation, access controls or service limits; accessing another user’s content; distributing malware; or disrupting the service.
• Reselling account access or using unauthorized automation to extract private data, abuse generation capacity or evade security restrictions.

You remain responsible for your authorized submissions and use of outputs. Provider moderation is an additional control, not proof that an accepted request is lawful or authorized.

9. Reports and appeals

Anyone, including a person depicted in an uploaded photo or generated video, can report unauthorized likeness use, infringement or other abuse to support@aicoffeefail.org. Include a link to the video or its task identifier if known, a description of the issue, your contact information and supporting context. You can still report without a link or identifier. Do not attach or redistribute illegal material; provide its location or identifying information instead. We may ask for more information to verify a claim or your authority to act.

We review reports and may restrict relevant access while investigating, coordinate with providers, remove content or suspend an account where justified. Urgent safety, fraud and legal concerns may require immediate action. Where practical and permitted, we explain the decision to the affected user and offer a chance to correct a remediable problem. You may request reconsideration by replying to the notice or emailing support with the decision identifier and your explanation. Review times depend on urgency and available information; we do not promise a fixed response time for every report.

10. Account closure and service changes

You can stop using the service at any time, delete a completed or failed task in My Creations, and contact support for account closure, provider-copy requests or unresolved cleanup. Account closure does not automatically clear browser drafts or erase payment records that must be retained. Deletion and retention limits are described in the Privacy Policy.

We may suspend or terminate access for material violations, fraud, security risks or legal requirements. When feasible, we provide notice and an opportunity to resolve the issue; urgent cases may require immediate restriction. A restriction does not automatically forfeit all unused paid credits. We assess their treatment under these Terms and applicable law, taking account of payment reversals and established misuse. You may appeal through the support channel above.

Permanent shutdown refunds

If we permanently discontinue the service, or permanently remove the paid generation service without a reasonably equivalent way to use existing credits, we will notify affected users, provide a reasonable download window where technically and legally possible, and refund the unused paid-credit portion.

This shutdown refund is separate from the seven-day policy and is not limited to unused packs.

For each purchase, the refund is calculated as follows: the amount paid multiplied by that pack’s remaining unused, unrevoked credits, divided by its original paid credits. The result is rounded to the nearest cent, with half cents rounded up.

• Credits already refunded or reversed are excluded, and the refund cannot exceed the purchase amount still unrefunded.
• Gift credits are excluded.
• Pending tasks must be settled or released before the final calculation.

Refunds use the original payment method where available, or another lawful arrangement if it is unavailable.

11. Warranties and liability

Except for our express commitments and rights that applicable law requires, the service is provided “as is” and “as available.” We do not guarantee uninterrupted access, permanent storage, or that every uploaded photo will be accepted.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses, such as lost profits or business opportunities. Nothing in these Terms excludes liability that cannot lawfully be excluded, limits mandatory consumer remedies, or overrides our express refund obligations. These limitations do not excuse fraud or willful misconduct. You do not waive non-waivable rights by using the service.

12. Updates and general terms

We will update the date when these Terms change. Material changes affecting paid services or your rights will receive advance website or email notice where required, with their effective date. Changes do not retroactively remove accrued refund rights or grant new optional content permissions. If you do not accept an update, stop using the affected features and contact us about outstanding purchases. We will obtain renewed acceptance where required by law.

These Terms govern service use; the Privacy Policy governs personal information handling, the Refund Policy governs voluntary refunds and service-credit remedies, and checkout disclosures describe the purchase offered. None overrides mandatory legal rights. We do not impose an exclusive governing law, forum or arbitration requirement through these Terms; applicable law determines your available rights and forum. If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcement does not waive a provision. Payment, content rights, applicable refunds and legal obligations survive closure as needed to give them effect. Contact support first if practical; this does not prevent seeking remedies available under applicable law.
